It’s yet another sign that the controversies around the El Paso District Attorney’s office are on the very cusp of becoming a huge national story.

On October 12, The Wall Street Journal ran a story about D.A. Yvonne Rosales, the effort to remove her from office, and how it could all affect the trial of the accused Walmart shooter.

The WSJ story is behind a paywall (ugh) but I can tell you a little of what it says.

The Journal’s Elizabeth Findell writes that the Walmart shooter trial has, “become mired in a political sideshow, including claims that a representative of District Attorney Yvonne Rosales impersonated the son of a victim in order to attack the judge.” 

The D.A.’s representative mentioned there is Roger Rodriguez, a judge in the Village of Vinton. An ad litem report written by local attorney and KLAQ contributor Justin Underwood alleges that Rodriguez developed a relationship with the family of shooting victim Alexander Hoffman with the goal of getting the judge in the case removed.

Now, the district attorney is calling Underwood and his report, “biased”.  Rosales also seems to accuse Underwood of harassing the Hoffman family. Her response to the report also included an affidavit from a Mexican attorney, Jose Morales.

The Underwood report claimed that the Hoffmans had never met with Morales nor did they agree to work with him. However, the affidavit, signed by Morales, claims he DID meet with the family on August 23rd and the family “reject(s) the appointment of this lawyer Justin Underwood, why they know to not have their best interests.”

Further, the letter from Morales to judge Sam Medrano, says, “Any further act by this lawyer…to antagonize and retaliate against the Hoffman family will be deemed an extraterritorial act against…citizens of Mexico and will be reported to Mexican authorities for prosecution”.

So now BOTH sides are claiming that the other is harassing the family of ONE OF THE WALMART VICTIMS!! It’s been more than three years since the shooting and THIS is where we are?

Just as it seems the handling of this case has run completely off the rails, they find OTHER rails to run off of.

Maybe one or more parties are lying (which would be PERJURY). Maybe Morales or Underwood are misrepresenting their meetings with the Hoffman family?

Maybe the Hoffmans are telling both attorneys different stories? But, it really seems like by now the scrutiny should be on the accused killer, NOT on the family of one of his victims.
