Suspicion Of DUI Arrest For 49ers Linebacker Aldon Smith

SAN JOSE, Calif. (AP) — San Jose police say 49ers linebacker Aldon Smith has been arrested on suspicion of driving under the influence.

Sgt. Heather Randol said officers arrested Smith after a solo vehicle crash in the city's Silver Creek area Friday morning. She did not give any additional details.

Smith is also facing a civil lawsuit from a man who says he was shot during a party at Smith's house.

Attorneys for Smith and former Niners tight end Delanie Walker, who is also named in the suit, say the plaintiff, Ronndale Esporlas, exposed himself to "all risks of harm" by attending the party.

Santa Clara County prosecutors say they are considering criminal charges.
